What is a Power of Attorney (POA)?

A Power of Attorney (POA) is a document which allows someone else to act and make decisions on your behalf. Without these documents, your family may have to resort to other legal means (like guardianship) to help you in the event of your incapacity. A Power of Attorney can allow another person to take charge of your health care or financial needs immediately upon signing, or it can become effective upon your incapacity (which is certified by a doctor). GoGo Estate allows you to make this decision.

What does it mean for a Power of Attorney to be "Durable?"

A "Durable" Power of Attorney simply allows someone else to make decisions on your behalf in the event of your incapacity or death. If the Power of Attorney were not Durable, your Agent would not have the power to act. Every Power of Attorney on GoGo Estate is Durable.

What is an "Agent?"

Many people colloquially refer to the person acting under a Power of Attorney as their "Power of Attorney." We at GoGo Estate know what you mean, but the law may not. The person who technically acts on your behalf under a Power of Attorney is known as your "Agent." An "Agent" is just a fancy way of saying "the person appointed to serve on your behalf under your Power of Attorney."

How do I make my documents legally binding?

In order for your Protection Plan documents to be legally binding, you must be over the age of eighteen (18) and of sound mind, you must sign each document in front of two (2) "disinterested witnesses," meaning two people who are not related to you or who will not be implicated in your Protection Plan documents, and you must have each document notarized.

What is HIPAA?

HIPAA stands for the "Health Insurance Portability and Accountability Act," and is a law which states that highly sensitive medical information cannot be released without your prior authorization. Because your health care Attorney-in-Fact is required to make health care decisions for you, GoGo Estate automatically includes a HIPAA Authorization so that they can carry out those powers.
