An Incontestability Clause is a provision in an estate planning document which prevents beneficiaries to the estate from contesting the terms of the document. This is a protective provision for the people who create the estate planning document as it ensures that their wishes are abided by. If a beneficiary attempts to file a lawsuit to break the intention of the person creating the estate plan, the beneficiary will generally not be allowed to inherit under the terms of the estate plan.
