The Problem

Jeremy and Christie were both on their second marriage. Each had children from their previous relationship and a set of twins together. While they loved and trusted one another, they heard horror stories from other blended families. They were concerned about protecting their respective children and their children together in the event of their untimely deaths.

Key Objectives

  1. Spousal Benefit: Jeremy and Christie wanted to make sure that if one of them dies that the other would still be able to benefit from their assets (Christie made considerably more than Jeremy, so allowing him to benefit from her estate was important).
  2. Guardianship: Because they had children from previous relationships as well as children together, guardianship was of the utmost importance.
  3. Bloodline Protection: Jeremy and Christie wanted to protect their respective bloodlines (their children from previous relationships and children together) without fear that any child would be written out of their estate plan.

The Solution

This plan allowed the surviving spouse to benefit from the deceased spouse's assets while simultaneously protecting their respective family bloodlines. Ultimately, their respective children could not be "written out" by the survivor of them.
